What are temp agency activities?
Temp agency activities refer to all services provided by an intermediary and which are aimed at hiring employees and making these employees available to users for temporary work.
In other words, the compulsory recognition not only applies to the mere establishment of the special employment relationship specific to the temp agency activity. It also applies to all services performed by an intermediary and which are aimed at the establishment of temporary agency work or the aforementioned special employment relationship. For example, recruitment and selection with the intention of performing temp agency activities is also subject to the compulsory recognition requirement.
Other activities related to private job placement such as 'assisting employees in finding new employment' or 'assisting employers in finding suitable employees are not subject to compulsory recognition. The fundamental distinction between these private job placement activities and temp agency activities lies in the nature of the employment relationship resulting from the mediation activity.
